The Nature and Biodiversity Conservation Union and the Green League of Brandenburg have once again failed with an emergency appeal against an initial permit for the construction of the factory of the US electric car company Tesla in Gruenheide near Berlin.
On Wednesday, the Higher Administrative Court (OVG) of Berlin-Brandenburg rejected an appeal by the environmental associations against a decision by the Administrative Court of Frankfurt an der Oder in June.
This means Tesla can test facilities and aggregates in the foundry, paint shop and body shop, as well as build and use tanks for rinsing and testing purposes.
The court confirmed the decision of the administrative court, which had rejected the urgent application against the early approval.
The court found that the environmental associations had not argued that, because of the tests that would be possible as a result of the permit, accidents or other adverse effects on the environment would have to be expected that had not been adequately taken into account.
The emergency application was also inadmissible because the associations had not argued that the decision affected their area of responsibility, that is the protection of nature and the environment.
Tesla lacks the final environmental permit for the construction of what it has dubbed its gigafactory. The company is therefore building via several early approvals.
