InfoQuest, (July 12, 2019) -- In May, DFT sent a delegation to attend the meeting of the Committee on Trade Rules within the framework of the World Trade Organization (WTO) held in Geneva, Switzerland, said Mr. Adul Chotinisakorn, director general of the Department of Foreign Trade (DFT) of the Ministry of Commerce (MOC) of Thailand. At the meeting, Thai representatives put forward many meaningful topics and expressed concern with the Committee on Anti-Dumping Practices about the United States’ anti-dumping measures (AD) against certain Thai products. It claimed that a particular market situation (PMS) exists in Thailand, making it impossible to calculate the dumping margin on the domestic sales price of Thai exporters. Meanwhile, it also raised the relevant costs and expenses without using the actual information provided by Thai exporters, resulting in a higher-than-actual dumping ratio of Thai exporters.
"Thai representatives voiced their objection at the meeting, claiming that the United States’ allegations against Thailand’s PMS have violated WTO rules, i.e., PMS rule shall be reasonably used only when necessary, and there must be sufficient evidence to prove that the selling prices in an exporter's country cannot be used to calculate the dumping margin".
In addition, the United States carried out continuous anti-dumping investigations on Thai products without rational reasons and adequate proof, which is also contrary to the provisions of the Anti-Dumping Agreement (ADA). Therefore, Thai representatives called on the United States’ compliance with ADA’s provisions and also requested all member states to adopt a case-by-case approach to PMS issues and work alongside each other on sound guidelines to ensure that member states use the PMS rule only for legitimate reasons.
Mr. Adul added that DFT delegation’s attendance is one of DFT’s important measures to protect the interests of Thai exporters. By using the WTO platform, Thailand tries to ensure that the anti-dumping investigation methods of the United States and other member states comply with ADA’s principles and purposes and Thai exporters are treated on an equal footing in the international market.
